Why IPO Annual Meeting 2025 Matters for AI and Patents

This year’s agenda aligns with Solve’s strategic vision, and here are the key AI-focussed sessions we’ll be engaging in:

  • Best Practices in Global Patent Drafting: A blueprint for adapting AI-assisted drafting to meet jurisdiction-specific standards and nuanced requirements, especially between the US and Europe.
  • What Can Outside Counsel Do Better & Differently for IP Teams: How AI platforms can enhance efficiency, responsiveness, and strategic contribution to IP teams big and small.
  • The Intersection of AI and Patents from the Perspective of Previous USPTO Directors: Former USPTO leaders will share perspectives on how AI tools are being used in prosecution, how offices are approaching AI as an inventor, and the treatment of AI-generated prior art.
  • Navigating the Complexities of AI Trade Secrets and Litigation: Issues around safeguarding AI-generated work product and maintaining confidentiality.
  • Bridging the Digital Divide: Navigating AI through the EU AI Act, US Regulations, and International Legislation: A deep dive into AI governance frameworks — crucial for compliant, future-proof AI tool adoption.

Our Goal at IPO Annual Meeting 2025

Our aim is simple: to collaborate with industry leaders on shaping the future of AI for patents.

  • End-to-End AI-Assisted Patent Process: Solve’s Patent Copilot™ delivers jurisdiction, technology, and user-specific drafting — precise, efficient, and customizable.
  • AI as the Drafting Co-pilot: Clients increasingly expect AI that complements human expertise. Solve’s approach ensures practitioners stay in the driver’s seat, shaping strategy and quality of patent portfolios.
  • Strategic Choice, Secure Implementation: We'll connect with patent leaders to explore how AI solutions are being evaluated, integrated, and aligned with firm-wide goals.
  • Supporting AI Champions & Building Trust: We’ll exchange ideas on establishing internal champions, cultivating governance frameworks, and defining KPIs that measure drafting turnaround, quality improvement, and overall ROI.

While in San Diego, we’ll also be hosting our Customer Advisory Board (CAB) meeting — bringing together leaders from our user community to:

  • Share the latest updates on Solve Intelligence.
  • Exchange feedback and strategic insights.
  • Co-create the roadmap for the future of AI in patent drafting, prosecution, invention harvesting, and more.

Our CAB is a core part of how we ensure our platform evolves with and for the practitioners who use it.

David Joo, our Founding Member of Products and Partnerships Counsel, will also be attending the IPO Leadership Meeting in his capacity as Vice Chair of the Small/Micro Law Firm & Company Committee.

USPTO Memo: Reminders for AI & Software Inventions

On August 4, 2025, the USPTO issued a memorandum to software-related art units about subject matter eligibility for AI and computer-implemented claims under 35 U.S.C. § 101. The memo emphasizes that it "is not intended to announce any new USPTO practice or procedure and is meant to be consistent with existing USPTO guidance".

This memo builds on and refers to previous July 2024 AI guidance. That guidance provided new examples and analytical frameworks for examining AI inventions. This memo attempts to ensure those frameworks are consistently applied across art units.

The memo addresses four areas where examiners often lack consistency when applying the Alice/Mayo steps: mental process analysis, distinguishing claims that recite versus involve judicial exceptions, analyzing claims as a whole, and determining when rejections are appropriate.
