Before you start: set guardrails that match your organization’s expectations

Before anyone opens an AI tool, you need to set clear boundaries and agree upon shared rules. In practice, this means:

  • Define what's in scope for the first 30 days. Specify which workflows are in scope (e.g. initial patent application drafting, continuation workflows, figure analysis, prosecution, or subject matter-specific features) and which are explicitly out of scope.
  • Set input rules and data handling. Decide what data can be used in the pilot and how it's stored, accessed, and deleted (ask your vendor). If you're using confidential client data, confirm your tool has zero-data retention agreements, encryption in transit and at rest, and SOC 2 Type II certification.

The First 30 Days of AI Adoption for Patent Attorneys

Days 1–3

Choose the pilot team and the workflow to test. Select the attorneys who are willing to test the tool, provide honest feedback, and document what they learn. Pick a workflow you do regularly (e.g., drafting specifications, responding to office actions, building claim charts) so you can compare results and refine the process.

Baseline current performance. Before you start using AI, measure how long the workflow currently takes and what quality issues typically arise. For example, how many hours does a first draft take? How many review cycles does it require? You won’t be able to assess any tool’s effectiveness without understanding your current performance.

Days 4–7

Set-up user access and permissions. Work with your IT team to set up single sign-on (SSO), configure data retention policies, and ensure the tool meets your security requirements. This eliminates the most common reason for delayed rollout: technical blockers that surface only after you've added 30 new users.

Create a one-page "how we use AI on patent work" guide. Compile a short document that explains what the tool does, what it doesn't do, and how your team should use it. For example, verify that all technical features are accurately described, check that claims align with the specification, and confirm that figures are referenced correctly. Use this checklist for every output in the pilot.

Track defects and near-misses. Log any errors, inconsistencies, or quality issues you catch during review. Note whether the issue was something AI introduced or something AI failed to catch. This helps you understand where AI adds value and where it needs more oversight.

Schedule a mid-trial check-in: Give feedback to the vendor and clarify questions as you are actively testing the software

Capture what works as reusable patterns. When you find a prompt, template, or workflow that produces good results, save it. Share it with the pilot team and test it on additional cases. These reusable patterns become the foundation of your scaled rollout.

Days 22–27

Document approvals, controls, and any client-specific constraints. If a rollout is chosen, write down who approved the rollout, what controls are in place, and any client-specific requirements. This documentation makes the rollout defensible if questions arise later.

Set a lightweight monitoring plan for the next 60–90 days. Plan to check in regularly with the expanded team to track usage, gather feedback, and address any new issues. Don't assume that what worked in the pilot will work perfectly at scale; stay close to the team and iterate as needed.
